Terms of use

1. Purpose

These terms govern access to the Zemiam app and the Zemiam website, and how they are used. They are accepted when an account is created. A person who does not accept them does not create an account.

The contract is entered into with ZEPRAUG & CO, Société par actions simplifiée (SAS), whose registered office is at 173 rue de Courcelles, 75017 Paris, France. The same publisher identity is repeated in the legal notice.

2. The service

Zemiam logs meals by photo, by barcode, by searching a product database, by voice, or by typing, then tracks what they add up to. It also tracks weight, hydration, and fasting.

Features evolve. A feature can be added, changed, or withdrawn, and a withdrawal that touches a paid feature is announced before it takes effect.

3. The account

An account is personal. Its credentials are not shared, and an entry made from an account is treated as made by its holder.

Minimum age: whatever the law of your country of residence requires for you to consent, on your own, to the processing of your data, and never under 13 in any case. Below that age, the consent of whoever holds parental responsibility is required, and Zemiam has no reliable way to check it. An account opened under the applicable age is closed as soon as it is reported.

Two thresholds are named because they were checked directly against their source: 13 in the United States, under the Children's Online Privacy Protection Act (COPPA), and 13 in the United Kingdom, under the Data Protection Act 2018. Where the law of another country sets a higher age, that higher age applies instead.

The account is deleted from the app: Profile tab, Account section, Delete account. Deletion is immediate and unconditional. What it removes and what remains is described in the privacy policy.

4. What the estimate is, and is not

An estimate produced from a photo or a description is an order of magnitude, computed by a statistical model. It depends on the photo, the angle, the preparation, and on whatever the plate does not show.

It is not medical advice, not personalized dietary advice, not a diagnostic tool, and not a prescription. A health question belongs with a health professional, and a medical condition, a pregnancy, a treatment, or a prescribed diet call for support that this app does not replace.

Values for packaged products come from Open Food Facts, a database maintained by its contributors. An entry can be incomplete or out of date. When in doubt, the product's own label is the reference.

5. Your relationship with the numbers

Counting what is on a plate helps some people and weighs on others. Zemiam shows numbers, with no comment and no instruction, by design: no notification asks for a day to be justified, and no message passes judgment on a meal or a body.

If tracking starts to take up a place that no longer fits, the journal can be cleared and the account deleted at any time, with no explanation required. Talking to a health professional remains the best way through, and crisis lines are named just below.

In an immediate crisis, these lines answer at any hour, every day: 988 in the United States and Canada, both free, the 116 123 Samaritans line in the United Kingdom and Ireland, free from a landline or a mobile, 13 11 14 Lifeline in Australia, free from a mobile and charged at the local call rate from a landline, and 1737 in New Zealand, free to call or text.

6. The subscription

Part of the app is free, with no limit: barcode scanning, manual entry, search, and weight and water tracking. Three AI analyses are included every calendar month, from a photo or from a meal described in one sentence, both counted against the same total.

The Zemiam Pro subscription opens these analyses beyond that quota, the fasting timer and its schedule, the macronutrient split, goal recalculation, and data export.

Zemiam Pro is offered as a monthly plan, an annual plan, and, where shown, a one-time introductory plan available for the first seven days after sign-up. Price, currency, and any introductory rate are set by the App Store or Google Play for your own territory, and are shown before purchase together with the renewal price that follows.

The trial is 3 days, then it renews. Both the monthly and the annual plan open with 3 days at no charge, once per store account. Cancelling during those days charges nothing. After them, the subscription renews at the price shown before purchase, and keeps renewing until it is cancelled. The one-time introductory plan above carries no trial.

The Founder Pack. While it is open, and within the limit of 1,000 members, the annual plan is offered under the name Founder Pack, at a launch price shown before purchase. That price is guaranteed to the founding member: it will not be increased, at any renewal, and it stays open to that member after a cancellation and a new subscription. Once the period closes or the places are taken, the annual plan is offered to new members at the price shown then, which is higher. The trial, the renewal, and the cancellation follow the rules above.

A time-limited offer, if shown, is real. Once the seven days pass, it does not reopen for that account, and no equivalent offer replaces it. This is stated plainly because a countdown that does not do what it says is unlawful in several of the countries this app is sold in.

The sale is the store's. The subscription is purchased exclusively inside the app, through the App Store or Google Play. Payment, billing, renewal, cancellation, and refund requests are governed by the terms of that store, and are managed from the store account.

Deleting the Zemiam account does not cancel a subscription, because the subscription does not belong to Zemiam. It is canceled from the store account, before or after deletion.

7. Fair use

Every photo analysis has a real cost. The subscription covers personal use, which the service estimates at a few analyses a day. Usage that clearly exceeds that order of magnitude, or that shows signs of an automated call, may be slowed and then suspended, after notice.

Not permitted:

• bulk or automated extraction of content, estimates, or the product database;
• reselling access to the service, or using it on behalf of a third party;
• attempting to bypass technical limits, quotas, or authentication;
• sending unlawful content through any input field.

8. Intellectual property

The Zemiam name, logo, mascot, interface, text, and code are protected and remain the publisher's property. An account grants a personal, non-exclusive, non-transferable right of use, for as long as the account exists.

Data entered remains that of the person who entered it. It is used only to run the service, and it can be exported and erased from the app.

Product data comes from Open Food Facts, distributed under the ODbL license. A contribution sent to that database from the app is published under the same license, which makes it reusable by everyone.

9. Availability

The service is provided as is, with no guarantee of continuous availability. An interruption may occur for maintenance, an incident, or because of a provider. Planned interruptions are announced when they can be foreseen.

10. Suspension and termination

An account may be suspended, then closed, in case of a clear breach of these terms, in particular of article 7. The measure is notified to the account's address, with its reason, and it can be disputed at contact@zepraug.com.

The account can be closed at any time, at its holder's initiative, from the app.

11. Liability

The publisher's liability cannot be engaged for the consequences of a food decision taken on the sole basis of an estimate, nor for an inaccuracy in a product entry drawn from a contributor-run database, nor for the unavailability of a third-party service.

Nothing in these terms limits the rights that consumer law grants you.

12. Governing law and disputes

These terms are governed by French law. Where you are a consumer, this choice does not remove the protection of any mandatory consumer-law provision of your own country of residence, which continues to apply alongside it.

A claim addressed to contact@zepraug.com usefully comes before any proceeding. Nothing here limits your right to bring a claim before the courts your own country's law grants you access to. A dispute over a subscription payment is governed by the terms of the store that sold it.

13. Changes

These terms may change. A substantial change is announced in the app before it takes effect, and continued use after that counts as acceptance. A person who refuses the new version deletes their account, and their data leaves with it.
